MINUTES OF THE SPECIAL MEETING
OF THE CITY COUNCIL
OF THE CITY OF DES PLAINES, ILLINOIS
HELD IN THE ELEANOR ROHRBACH MEMORIAL COUNCIL CHAMBERS,
DES PLAINES CIVIC CENTER,
MONDAY, JULY 30, 2007
CALL TO ORDER:
The Special meeting of the City Council of the City of Des
Plaines, Illinois, was called to order by Mayor Anthony W. Arredia
at 6:30 P.M. in the Eleanor Rohrbach Memorial Council Chambers, Des
Plaines Civic Center on Monday, July 30, 2007.
ROLL CALL:
Roll call indicated the following aldermen present: Moylan,
Murphy, Higgason, Brookman, Walsten, Argus. Aldermen Beauvais and
Smith were absent. Alderman Beauvais arrived at 6:31 p.m.
Also present were: Acting City Manager Bajor, Director of
Community & Economic Development Conlan, Deputy Director of
Community & Economic Development Spiel, Assistant Director of
Engineering Duddles, Fire Division Chief Thiry. Building Inspector
Ehrke, Building Inspector Biancalana, Electrical Inspector
Mugerditchian and City Attorney Wiltse.
EXECUTIVE SESSION:
Moved by Beauvais, seconded by Brookman, to go into Executive
Session to discuss acquisition of real property. Upon roll call, the
vote was:
AYES: 7-Beauvais, Moylan, Murphy, Higgason,
Brookman, Walsten, Argus
NAYS: 0-None
ABSENT: 1-Smith
Motion declared carried.
The City Council recessed at 6:31 p.m.
The City Council reconvened at 6:45 p.m.
Roll call indicated the following aldermen present: Beauvais,
Moylan, Murphy, Higgason, Brookman, Walsten, Argus.
ACQUISTION OF REAL PROPERTY/POLICE STATION APPRAISER:
Moved by Beauvais, seconded by Brookman, to concur with consensus
reached in Executive Session regarding Police Station appraisal and
that the Staff proceed as directed with final action to be taken in
open session at a future date. Motion declared carried.
MAYOR ARREDIA DECLARED THAT THE CITY COUNCIL WAS NOW RESOLVED
INTO A COMMITTEE OF THE WHOLE
BUILDING CODE Alderman Higgason, Chair
REVISION OF BUILDING CODE:
Director of Community & Economic Development Conlan stated that
the City is required to revise its Building Code in order to be in
compliance with the standards of the 2006 International Code Council
and to maintain its certification rating with the International
Organization for Standards; the Building Code Committee conducted
seven (7) meetings to review and revise the proposed Code language
and fee structure.
Deputy Director of Community Development Spiel gave a PowerPoint
presentation on the necessity of amending the Building Code.
Mr. Brian Burkross, 2133 Webster Lane, addressed the Committee of
the Whole stating that he could not attend the Building Code
Committee meetings; will grandfathering take effect?; how will this
better our ISO rating?
Director of Community & Economic Development Conlan stated that
grandfathering would be in effect for those permits issued before
the amendments take affect.
Deputy Director of Community & Economic Development Spiel stated
that updating our Code is one of the criteria they use to determine
the rating; the Citys current rating is a 3 on a scale from 0-10
with 0 being the best rating; we would like to stay at a 3 or
better.
Moved by Murphy, seconded by Walsten, to concur with Staff
recommendation and recommend to the City Council approval of the
"Adoption of the International Building Code"; and further recommend
to place on First Reading Ordinance M-37-07 at appropriate time this
evening. Motion declared carried.
Moved by Murphy, seconded by Argus, to concur with Staff
recommendation and recommend to the City Council approval of the
"Adoption of the International Mechanical Code"; and further
recommend to place on First Reading Ordinance M-38-07 at appropriate
time this evening. Motion declared carried.
Moved by Beauvais, seconded by Murphy, to concur with Staff
recommendation and recommend to the City Council approval of the
"Adoption of the International Fuel Gas Code"; and further recommend
to place on First Reading Ordinance M-39-07 at appropriate time this
evening. Motion declared carried.
Moved by Beauvais, seconded by Murphy, to concur with Staff
recommendation and recommend to the City Council approval of the
"Adoption of the International Fire Code"; and further recommend to
place on First Reading Ordinance M-40-07 at appropriate time this
evening. Motion declared carried.
Moved by Beauvais, seconded by Moylan, to concur with Staff
recommendation and recommend to the City Council approval of the
"Adoption of the ICC Electrical Code"; and further recommend to
place on First Reading Ordinance M-41-07 at appropriate time this
evening. Motion declared carried.
Moved by Murphy, seconded by Moylan, to concur with Staff
recommendation and recommend to the City Council approval of the
"Adoption of the International Residential Code for One-and
Two-Family Dwellings"; and further recommend to place on First
Reading Ordinance M-42-07 at appropriate time this evening. Motion
declared carried.
Alderman Murphy stated that the City does not have codes to
address trampolines.
Deputy Director of Community & Economic Development Spiel stated
that trampolines would be addressed in the Zoning Code when it is
updated in the upcoming months.
Moved by Murphy, seconded by Beauvais, to concur with Staff
recommendation and recommend to the City Council approval of the
"Adoption of the International Plumbing Code"; and further recommend
to place on First Reading Ordinance M-43-07 at appropriate time this
evening. Motion declared carried.
Moved by Beauvais, seconded by Murphy, to concur with Staff
recommendation and recommend to the City Council approval of the
"Adoption of the International Property Maintenance Code"; and
further recommend to place on First Reading Ordinance M-44-07 at
appropriate time this evening. Motion declared carried.
Moved by Murphy, seconded by Walsten, to concur with Staff
recommendation and recommend to the City Council approval of the
"Adoption of the International Energy Conservation Code"; and
further recommend to place on First Reading Ordinance M-45-07 at
appropriate time this evening. Motion declared carried.
Mr. Brian Burkross, 2133 Webster Lane, addressed the Committee of
the Whole stating that the new requirement for driveway width is
10; he has a shared driveway that only measures 9 and cannot be
expanded to 10.
Director of Community & Economic Development Conlan stated that
in that situation, his driveway would be grandfathered.
Alderman Brookman stated that she requests that the Ordinances
not be adopted until the next City Council meeting to give
contractors and residents a chance to obtain this information.
Alderman Murphy stated that Building Code Committee meetings have
been ongoing since January and the changes have been available on
the City website.
Moved by Murphy, seconded by Moylan, to concur with Staff
recommendation and recommend to the City Council approval of
amendments to the "Driveway and Hard Surface Limitations"; and
further recommend to place on First Reading Ordinance M-46-07 at
appropriate time this evening. Motion declared carried.
Moved by Beauvais, seconded by Murphy, to concur with Staff
recommendation and recommend to the City Council approval of
"Additional Improvements within the City Limits" of the Subdivision
Regulations section; and further recommend to place on First Reading
Ordinance M-47-07 at appropriate time this evening. Motion declared
carried.
Moved by Murphy, seconded by Moylan, to concur with Staff
recommendation and recommend to the City Council approval of
"Driveway Construction" amendments; and further recommend to place
on First Reading Ordinance M-48-07 at appropriate time this evening.
Motion declared carried.
PUBLIC SAFETY Alderman Beauvais, Chair
COMMERCIAL REAL ESTATE APPRAISER/POLICE STATION:
Alderman Beauvais stated that in order to proceed with a
selection of a site for a new Police Station, an agreement for
appraisal services will need to be approved; Staff has recommended
that the firm of Gibbons & Gibbons, Ltd. be approved for appraisal
services in connection with the acquisition of a site for a new
police facility at a cost not to exceed $13,000.
Moved by Beauvais, seconded by Brookman, to recommend to the City
Council to approve an agreement for appraisal services with Gibbons
& Gibbons, Ltd., 401 S. LaSalle Street, Suite 1502, Chicago, IL
60605, in connection with the acquisition of a site for a new police
facility at a cost not to exceed $13,000; and further recommend that
Resolution R-104-07 be adopted at appropriate time this evening.

BACK IN SESSION

Moved by Higgason, seconded by Murphy, to concur with
recommendation of Committee of the Whole approval of the "Adoption
of the International Building Code"; and further recommend to place
on First Reading Ordinance M-37-07. Motion declared carried.
Moved by Higgason, seconded by Argus, to concur with
recommendation of Committee of the Whole approval of the "Adoption
of the International Mechanical Code"; and further recommend to
place on First Reading Ordinance M-38-07. Motion declared carried.
Moved by Higgason, seconded by Murphy, to concur with
recommendation of Committee of the Whole to approve the "Adoption of
the International Fuel Gas Code"; and further recommend to place on
First Reading Ordinance M39-07. Motion declared carried.

recommendation of Committee of the Whole approve the "Adoption of
the International Fire Code"; and further recommend to place on

the ICC Electrical Code"; and further recommend to place on First

recommendation of Committee of the Whole to approve "Additional

AMENDING TITLE 13, "SUBDIVISION REGULATIONS," CHAPTER 3, "DESIGN
IMPROVEMENTS," SECTION 2, "ADDITIONAL IMPROVEMENTS WITHIN CITY
LIMITS," OF THE CITY OF DES PLAINES CITY CODE. Motion declared
